The short version
These terms govern using this website and our online application. They are not your lease — the lease is its own document. Texas law applies. You agree to honest dealing and to receive electronic notices. We can change these terms with notice on this page.
1. Who these terms are with
These Terms & Conditions ("Terms") are an agreement between you and Gated Rentals ("we", "us") operating the brand Crosby Heights in Crosby, Texas. They apply to your use of crosbyheights.com, apply.crosbyheights.com, and any other website, form, or service we operate under the Crosby Heights name (collectively, the "Services").
2. These terms are not your lease
Your residential lease agreement, if you sign one, is a separate written contract executed by you and us. Where these Terms conflict with the lease, the lease controls between you as resident and us as landlord for the leased premises. These Terms only govern your use of the Services and any related online interactions (applying, scheduling, paying, messaging).
3. Eligibility
You must be at least 18 years old and legally able to enter into a contract to use the Services. By submitting an application you confirm that the information you provide is accurate to the best of your knowledge.
4. Your account and online application
- You are responsible for keeping your one-time passcode ("OTP") and any application-resume link confidential. We use OTP-based authentication; you are responsible for activity from a device that has completed OTP verification.
- Application fees are non-refundable once a screening report has been ordered, except where required by law.
- You authorize us to obtain consumer reports as part of screening (see our Privacy Policy and our FCRA notice).
- You agree we may rely on the contact information you provide and that notices to those addresses are valid.
5. Electronic communications and signatures
You consent to receive communications from us electronically — by email, SMS, in-app, and through the Services. You agree that electronic signatures, contracts, notices, and other records have the same legal effect as paper signatures under the federal E-SIGN Act and the Texas Uniform Electronic Transactions Act.
6. Payments
- Card and ACH payments are processed by Authorize.Net. By submitting a payment you authorize us and our processor to debit the account or card you provide for the amount stated.
- ACH (eCheck) authorization — when you choose to pay by ACH, you authorize us and our processor to initiate an electronic debit to the bank account you provide for the amount and frequency you agree to. You represent that you are an authorized signer on that account. You can revoke ACH authorization for future debits by emailing crosbyheights@gatedrentals.com at least three business days before the next scheduled debit. Revocation does not relieve you of obligations already incurred under your lease.
- Returned payment — returned card or ACH transactions may be assessed a returned-payment fee as stated in your lease or fee schedule, plus any fee assessed by your bank.
- Receipts and refund processing are described in our Privacy Policy and the lease.
7. SMS messaging
Use of our SMS messaging is governed by our SMS Terms & Opt-In, which is incorporated into these Terms. Reply STOP to any text to opt out. Message and data rates may apply.
8. Acceptable use
You agree not to:
- Submit false, misleading, or fraudulent information.
- Use someone else's identity, SSN, bank account, or card.
- Interfere with the Services, attempt unauthorized access, scrape, or run automated tools against our systems beyond ordinary browsing.
- Use the Services in violation of any law, including fair housing laws, FCRA, and the Texas Property Code.
9. Fair housing
We comply with the federal Fair Housing Act and the Texas Fair Housing Act. We do not discriminate on the basis of race, color, national origin, religion, sex (including sexual orientation and gender identity), familial status, disability, or any other class protected by applicable law.
10. Intellectual property
The Services, including text, photographs of the property, page layouts, and code, are owned by Gated Rentals or its licensors and are protected by copyright. You may use the Services for your own application and resident purposes. You may not republish, scrape, or commercially reuse the content.
11. Third-party services
The Services use third-party providers including Plaid (identity and income), Kredifi (screening), Authorize.Net (payments), Microsoft and Azure Communication Services (messaging), and Cloudflare (infrastructure). Your use of those parts of the Services is also subject to those providers' terms.
12. Disclaimer
The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted service, that the Services will be error-free, or any particular outcome of an application.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Services. Our total liability for any claim arising from the Services (not including the lease) is limited to the amount you paid us in application fees in the preceding 12 months.
Nothing in these Terms limits liability that cannot be limited by law, including gross negligence, willful misconduct, or fraud.
14. Indemnification
You agree to indemnify and hold us harmless from any claim arising from your breach of these Terms, your misuse of the Services, or your violation of law in connection with the Services. This does not apply to the extent the claim is caused by our own negligence or willful misconduct.
15. Governing law and venue
These Terms are governed by the laws of the State of Texas without regard to its conflict-of-laws principles. Any dispute will be resolved exclusively in the state or federal courts located in Harris County, Texas, except disputes that are required to be arbitrated under your lease (if any).
16. Changes
We may update these Terms from time to time. We will post the new effective date at the top. Material changes will be announced on this page and, where appropriate, by email or SMS. Your continued use of the Services after a change means you accept the new Terms.
